You need to gather this information

1. Gather paperwork for all your debts

This will help you to complete your application. You can use the statements from each of your creditors. Or list the amount you owe, the account number and the address for each creditor.

2. Complete the application

  • England & Wales: Complete form N92 with details of your income, spending and debts, but do not sign. You will need a court officer to witness your signature at the court
  • Northern Ireland: Contact the Enforcement of Judgments Office (EJO) to request a Form 11. When you get this, complete it with details of your income, spending and debts

3. Submit your application County Court

  • England & Wales: Take your N92 form to the nearest County Court to submit it. You can find your nearest County Court using this online tool. You can also attach a copy of your budget to give more detail about your financial situation
  • There is no guarantee that the Court will consider your budget. So it is still important that you fully complete the income and expenditure information on the N92 form.

If they think your case is straightforward, the court may make a decision without a hearing.

However, the court may ask you to attend a hearing. A judge will decide if you are granted an admin order. They will also decide how much your payment will be.

  • Northern Ireland: You can call the Enforcement of Judgments Office on 0300 200 7812 to arrange an appointment to submit your application.
  • Take or send your copy of Form 11 to the EJO to submit it. You can also attach a copy of your budget to give more detail about your financial situation.

However, there is no guarantee that the EJO will consider the budget. So, it is still important you fully complete the income and expenditure information in the form.

The EJO will let you know the hearing date and also inform your creditors of this. A court judge, or ‘Master’ will then decide if you are granted an admin order. They will also decide how much your payment will be.

Tell your creditors you are getting our help

Please contact your creditors and ask for time to deal with your debts.

Tell them you are getting our help and ask them what "forbearance" is available.

This means you are asking your creditors to hold back from forcing you to pay your debt, or taking further legal action.

They will usually:

  • Stop their collection process
  • Give you time to set up your debt solution
  • Leave you alone for 30 days after you tell them you are getting help

Give them a call or send them an email. There is a template in the 'Your next steps' section of your Personal Action Plan.

If you have already applied for Breathing Space or a moratorium, then your creditors will have been alerted.

Start making payments

  • England & Wales: Once your admin order is approved, you will receive details from the court about how to make your monthly payments
  • Northern Ireland: Once your admin order is approved, you will receive details from the EJO about how to make your monthly payments.
